The OEA\u00a0 Board of Directors will be presented with a report listing the Buckeye Loc CTA Constitution and\u00a0 Bylaws as being in compliance with OEA Bylaw 9-2 \u2013 Standards for Affiliation.\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">This OEA Board of Directors&#8217; review does not mean that the Constitution and Bylaws have been ratified\u00a0 by the members of Buckeye Loc CTA in accordance with the Article of Amendments contained in the\u00a0 Constitution and Bylaws. The ratification of the local&#8217;s Constitution and Bylaws is the role of the local.\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">The next Constitution and Bylaws review is scheduled in May of 2028. Therefore, it is recommended\u00a0 that this review date be placed on your local\u2019s official calendar. Prior to this review date, the current\u00a0 local president will need to contact OEA to request an updated standards test and an OEA Model\u00a0 Constitution and Bylaws to ensure that the local Constitution and Bylaws remains in compliance. The name of this organization shall be the BUCKEYE LOCAL CLASSROOM\u00a0 TEACHERS\u2019 ASSOCIATION.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B. <\/span><\/i><span style=\"font-weight: 400\">The BUCKEYE LOCAL CLASSROOM TEACHERS\u2019 ASSOCIATION henceforth\u00a0 referred to as the Association, shall maintain affiliation with the Eastern Ohio Education\u00a0 Association, the Ohio Education Association, and the National Education Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE II\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Purpose<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">The purpose of the Association shall be to:\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Help set and promote the educational objectives of the local school system and of the state and\u00a0 of the nation;\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Protect the welfare and advance the professional interests of its members; Foster professional attitudes;\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Establish and maintain helpful, friendly relationships within the membership and school\u00a0 community.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE III\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Membership<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">Any person employed by the Buckeye Local Board of Education as a classroom\u00a0 teacher who does not hold an administrative or principal\u2019s position may become an active\u00a0 member.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B. <\/span><\/i><span style=\"font-weight: 400\">The membership in the Association shall consist of two classes: Active and\u00a0 Honorary.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C. <\/span><\/i><span style=\"font-weight: 400\">Active members shall be members of the Buckeye Local Classroom Teachers\u2019\u00a0 Association, the Eastern Ohio Educational Association, the Ohio Education Association, and the\u00a0 National Education Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section D<\/span><\/i><span style=\"font-weight: 400\">. Honorary membership in this Association shall be open to all retired teachers of\u00a0 Buckeye Local School District. Honorary members cannot vote, hold office or attend general\u00a0 sessions.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section E. <\/span><\/i><span style=\"font-weight: 400\">Any person holding an administrative or principal\u2019s position, and any other\u00a0 professional school personnel in the Buckeye Local School District may be extended the\u00a0 courtesy of honorary membership.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section F<\/span><\/i><span style=\"font-weight: 400\">. All members shall abide by the Code of Ethics of the Education Profession. <\/span><b>ARTICLE IV\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Officers<\/span><\/i><i><span style=\"font-weight: 400\">\u00a0<\/span><\/i><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">The Officers of the Association shall be the President, Vice President, Secretary, and\u00a0 Treasurer.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. All Officers shall hold office for a two-year term beginning June 1st and ending May\u00a0 31st. The President and Vice President shall be elected in odd years. The Treasurer and\u00a0 Secretary will be elected in even years.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C<\/span><\/i><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Whenever the office of President becomes vacant due to death, incapacity, termination,\u00a0 resignation, retirement or recall, the Vice President shall automatically assume the presidency\u00a0 for the remaining part of the term.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> A vacancy in the office of Vice President, Secretary, or Treasurer, shall be filled by an\u00a0 appointment of the President with the approval of two-thirds of a quorum of the Board of\u00a0 Directors\/Executive Committee in a secret ballot.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><b>ARTICLE V\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Executive Committee<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A<\/span><\/i><span style=\"font-weight: 400\">. The Executive Committee shall be composed of the elected officers of the\u00a0 Association and Association Representatives. The President, Vice President, Secretary,\u00a0 Treasurer, and Association Representatives must be elected by secret ballot.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. The Executive Committee shall:<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Act as advisors to the officers, assign duties, be responsible for all committees of the\u00a0 Association, and have such policy-making authority as provided in this Constitution and By Laws.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Act as the authoritative voice of the Association on positions affecting the Association during\u00a0 the interim period between regular meetings.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Prepare recommendations for the consideration and action of the Association. 4. Carry out policies established at general membership meetings.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Report its transactions and those of the general membership to all members.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Direct an independent audit of the Association\u2019s financial records at regular intervals not to\u00a0 exceed two (2) years.\u00a0<\/span><\/li>\n<li><i> <\/i><span style=\"font-weight: 400\">The auditing of books will take place before May 15. The President shall appoint the auditing\u00a0 committee.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Ensure the Association acts on an annual financial report presented by the Association\u00a0 Treasurer.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C<\/span><\/i><span style=\"font-weight: 400\">. There will be one association representative elected for a term of one year in each\u00a0 building for every 15 members or fraction thereof. Each representative has one vote on the\u00a0 Executive Committee.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section D<\/span><\/i><span style=\"font-weight: 400\">. It is the policy of this Association, and it shall take all legally permissible steps to\u00a0 achieve governance and delegate representation of ethnic minority at least proportionate to the\u00a0 ethnic minority membership in the Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section E. <\/span><\/i><span style=\"font-weight: 400\">Certified member(s) and education support professionals shall be elected to the\u00a0 Executive Committee in proportion to their respective membership in the Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section F<\/span><\/i><span style=\"font-weight: 400\">. A vacancy on the Executive Committee due to death, incapacity, termination,\u00a0 resignation, retirement or recall, shall be filled for the remainder of the term by majority vote of\u00a0 the Executive Committee of the local.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section G<\/span><\/i><span style=\"font-weight: 400\">. No business or financial transaction involving a member of the Executive committee\u00a0 or agent of the Association, or their spouse, children, or parents, or otherwise as described in\u00a0 this Section, shall conflict with the fiduciary responsibility of such person to the Association.\u00a0 Such relationships with the members of the Executive Committee include relationships with any\u00a0 person that would reasonably be expected to affect the person\u2019s judgment with respect to the\u00a0 transaction of conduct in question in a manner adverse to the Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE VI\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Elections<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">The President shall appoint a Nominating Committee whose duty it shall be to\u00a0 present a slate of officers for each office. Candidates for office may also be submitted by a\u00a0 petition signed by at least seven (7) active members or by nomination from the floor.<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. No member shall be nominated for office without the knowledge and consent of the\u00a0 individual.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C<\/span><\/i><span style=\"font-weight: 400\">. The President shall appoint an Elections Committee whose duty it shall be to\u00a0 conduct elections in accordance with the OEA Elections Manual and to resolve all challenges or\u00a0 protests to an election. No nominee for office shall serve concurrently on the Elections\u00a0 Committee.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section D<\/span><\/i><span style=\"font-weight: 400\">. Elections of officers and Executive Committee members shall be conducted by\u00a0 secret ballot in each building during one school day designated by the Elections Committee on\u00a0 or before the first Friday in May.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section E. <\/span><\/i><span style=\"font-weight: 400\">The Elections Committee shall report the results of the election to the total\u00a0 membership within five (5) calendar days following the election.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section F<\/span><\/i><span style=\"font-weight: 400\">. All ballots (marked, unmarked, and voided) and all other records pertaining to the\u00a0 election of officers of this Association and OEA and NEA delegates and alternates shall be\u00a0 preserved for one year from the date the election was held; and such ballots and other records\u00a0 shall be made available to OEA officers upon request for inspection and examination.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section G<\/span><\/i><span style=\"font-weight: 400\">. Non-members of the Association, including fee payers, shall not have the right to\u00a0 vote, hold office, or otherwise have privilege of Association membership.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE VII\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Impeachment of Officers<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">Officers of the Association may be impeached for violation of the Code of Ethics of\u00a0 the Education Profession or for misfeasance, malfeasance, or nonfeasance in office.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. Impeachment proceedings against an officer may be initiated by written petition\u00a0 submitted to the Executive Committee by at least twenty-five (25) percent of the members.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C. <\/span><\/i><span style=\"font-weight: 400\">If, after a due-process hearing, a two-thirds (2\/3) vote of the Executive Committee\u00a0 sustains the charge, the office shall become vacant.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section D<\/span><\/i><span style=\"font-weight: 400\">. The officer may appeal the decision to a special meeting of the general membership. <\/span><b>ARTICLE VIII\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Committees<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A. <\/span><\/i><span style=\"font-weight: 400\">The Association shall have such standing committees as are necessary to carry out\u00a0 the responsibilities and program of the Association. The President with approval of the\u00a0 Executive Committee shall appoint all committees.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. The duties of committees shall be such as are determined by the Executive\u00a0 Committee.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section C<\/span><\/i><span style=\"font-weight: 400\">. Ad hoc (temporary) committees may be formed as necessary to achieve the\u00a0 Association Program.<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE IX\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Dues<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A<\/span><\/i><span style=\"font-weight: 400\">. The local association shall have a dues structure adequate to fund an active\u00a0 program.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section B<\/span><\/i><span style=\"font-weight: 400\">. Title II Reduction Teachers and Sixty (60) day substitute teachers will pay the full\u00a0 Buckeye Local Classroom Teachers\u2019 Association dues.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE X\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Amendments<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A<\/span><\/i><span style=\"font-weight: 400\">. Amendments to this Constitution may be made by a two-thirds (2\/3) majority of those\u00a0 voting at any regular meeting provided that the amendments have been introduced at least\u00a0 fifteen (15) days prior to the voting date; and that copies of proposed amendments have been\u00a0 distributed to all members for discussion.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>ARTICLE XI\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Alignments<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A<\/span><\/i><span style=\"font-weight: 400\">. This Association reserves the right to align itself with any professional organizations. <\/span><b>ARTICLE XII\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Ethnic Minority on Governing Body<\/span><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section A<\/span><\/i><span style=\"font-weight: 400\">. Ethnic minority representation shall be guaranteed at least proportionate to the\u00a0 Association\u2019s ethnic minority membership.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BUCKEYE LOCAL CLASSROOM TEACHERS\u2019 ASSOCIATION BY-LAWS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><b>BYLAW 1. MEETINGS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 1-1 <\/span><\/i><span style=\"font-weight: 400\">The Board of Directors\/ Executive Committee shall meet monthly or at the call of\u00a0 the President.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 1-2 <\/span><\/i><span style=\"font-weight: 400\">The general membership meetings shall be held at least twice per year, e.g. one\u00a0 in spring and one in the fall or once in September and once in May. Additional meetings may be\u00a0 called by the President, a majority vote of the Board of Directors\/ Executive Committee, or a\u00a0 petition to the President signed by at least ten (10) percent of the active membership. Such\u00a0 petitions shall state the purpose of the desired meeting and the business of that meeting shall\u00a0 be limited to consideration of the stated purpose.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 2. QUORUM\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 2-1 <\/span><\/i><span style=\"font-weight: 400\">The quorum for the Board of Directors\/Executive committee meetings shall be\u00a0 one more than fifty (50) percent.<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 2-2 <\/span><\/i><span style=\"font-weight: 400\">The quorum for a general meeting shall be the membership present. <\/span><b>BYLAW 3. DUTIES OF OFFICERS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 3-1 <\/span><\/i><span style=\"font-weight: 400\">President\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Preside over all Association meetings and prepare their agendas.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Represent the Association on all matters of Association policy.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Serve as ex-officio member of all Association committees.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Represent the Association at Uniserv Council meetings.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Serve as a delegate to the OEA Representative Assembly by virtue of his\/her office. F. Serve as a delegate to the EOEA Representative Assembly by virtue of his\/her office. <\/span><i><span style=\"font-weight: 400\">Section 3-2 <\/span><\/i><span style=\"font-weight: 400\">Vice President\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Preside over Association meetings in the absence of the President.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Perform such other duties as delegated by the President.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Carry out the duties of the President in their absence including the signing of all legal\u00a0 documents and\/or forms.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Represent the Association at the Uniserv Council meetings.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Serve as a delegate to the OEA Representative Assembly by virtue of his\/her office. F. Serve as a delegate to the EOEA Representative Assembly by virtue of his\/her office. <\/span><i><span style=\"font-weight: 400\">Section 3-3 <\/span><\/i><span style=\"font-weight: 400\">Secretary\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Keep accurate minutes of all official meetings of the Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Maintain official files of the Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Perform such other duties as delegated by the President.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 3-4 <\/span><\/i><span style=\"font-weight: 400\">Treasurer\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Hold the funds of the Association and disburse them upon authorization of the Board of\u00a0 Directors\/Executive Committee.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Maintain records of receipts and disbursements.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Prepare financial reports for meetings of the Board of Directors\/Executive Committee and an\u00a0 annual financial statement to be distributed to the membership.<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Prepare for an independent audit as authorized by the Board of Directors\/Executive\u00a0 Committee.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Shall be bonded.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Chair the Budget Committee.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 3-5 <\/span><\/i><span style=\"font-weight: 400\">Association Representative\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Report recommended policies and other actions of the Board of Directors\/Executive\u00a0 Committee to members in her\/his building or unit of representation.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Transmit proposals and recommendations from members in her\/his building or unit of\u00a0 representation to the Board of Directors\/Executive committee for its consideration.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Assist the membership committee in the collection of dues.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Assist the elections committee in the distribution and collection of ballots. E. Attend all official meetings of the Association or provide an alternate in her\/his absence.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Act as a consultant to the individual member who has a professional problem and, when\u00a0 necessary, seek needed assistance from the Association.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 3-6 <\/span><\/i><span style=\"font-weight: 400\">Teacher Professional Organization Stipends\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> The Board of Education will pay an annual stipend to the Officers and Association\u00a0 Representatives who serve on the BLCTA Executive Committee. The Association shall certify\u00a0 the stipend amounts to the Board\u2019s Treasurer, which can in no event exceed the maximum\u00a0 amount allowed by ORC Rule 3307-6-01. The Association shall promptly and fully reimburse the\u00a0 Board for the total cost of the stipends, including any applicable retirement costs\/workers\u00a0 compensation\/Medicare.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><b>BYLAW 4. COMMITTEES\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 4-1 <\/span><\/i><span style=\"font-weight: 400\">There shall be the following committees:\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Negotiations <\/b><span style=\"font-weight: 400\">\u2013<\/span><span style=\"font-weight: 400\"> assess membership concerns prior to bargaining, develop initial proposals of\u00a0 the Association, and provide additional advice and input, upon the request of the bargaining\u00a0 team, during active negotiations.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Elections<\/b> <span style=\"font-weight: 400\">\u2013 charged with the responsibility to protect the integrity of an election or vote and\u00a0 ensure that an election is conducted in accordance with the guidelines set forth in the OEA\u00a0 Election Manual and with local, state, and national constitutions.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Grievance<\/b> <span style=\"font-weight: 400\">\u2013 maintenance of, and membership advocacy in, grievance procedure.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Insurance<\/b> <span style=\"font-weight: 400\">\u2013 will examine, research and report methods of maintaining and improving benefits\u00a0 and reducing the cost of health insurance coverage to be composed of 3 members of the\u00a0 bargaining unit selected by the Executive Committee and 3 members appointed by the Board.<\/span><\/p>\n<p style=\"text-align: left\"><b>Budget\/Fiscal Fitness <\/b><span style=\"font-weight: 400\">\u2013<\/span><span style=\"font-weight: 400\"> prepares a budget giving estimates of income and expenditures\u00a0 (including a separate estimate for each committee) for the future fiscal year.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Audit <\/b><span style=\"font-weight: 400\">\u2013<\/span><span style=\"font-weight: 400\"> checks accuracy of accounting procedures. The auditing of books will take place before\u00a0 May 15th of each year. The President shall appoint the auditing committee.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Membership <\/b><span style=\"font-weight: 400\">\u2013<\/span><span style=\"font-weight: 400\"> maintains membership rolls, conducts and \/or assists with membership drives,\u00a0 works in conjunction with the treasurer.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Constitution and Bylaws <\/b><span style=\"font-weight: 400\">\u2013<\/span><span style=\"font-weight: 400\"> reviews and submit to OEA the local\u2019s C&amp;B when amended or\u00a0 every five years.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Sick Bank<\/b> <span style=\"font-weight: 400\">\u2013 composed of the members of the Executive Committee who will review all\u00a0 applications for sick bank usage and make final determination.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BLCTA Scholarship<\/b> <span style=\"font-weight: 400\">\u2013 provide applications to Guidance department, review applications, select\u00a0 and notify award recipient.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Section 4-2 Necessary sub-committees may be appointed, as needed, by the\u00a0 committee chairperson.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 5. BARGAINING AND CONTRACT RATIFICATION\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-1 <\/span><\/i><span style=\"font-weight: 400\">The Association shall be represented in collective bargaining by an\u00a0 authorized team of Association Representatives appointed by the President and Board of\u00a0 Directors\/Executive Committee.\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> If the President is not an active member of the bargaining team, the President will be an ex officio member of the Association bargaining team.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Members of the bargaining team need not necessarily be from the negotiations committee. C. Necessary sub-committees may be appointed, as needed, by the committee chairperson.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> The bargaining team shall have the authority to bargain in good faith; make proposals,\u00a0 counterproposals, and concessions; and make tentative agreement on a contract with\u00a0 representatives of the Board of Education.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> While negotiations are in progress, periodic reports to members may be made by the\u00a0 bargaining team.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-2 <\/span><\/i><span style=\"font-weight: 400\">In preparation for bargaining, the negations committee shall make reports\u00a0 and recommendations to the Board of Directors\/Executive Committee.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-3 <\/span><\/i><span style=\"font-weight: 400\">The Ohio Education Association represents the Association on all matters\u00a0 concerning the Association before the State Employment Relations Board (SERB).\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-4 <\/span><\/i><span style=\"font-weight: 400\">The OEA\/NEA UniServ Consultant shall be the Association\u2019s designated\u00a0 bargaining representative.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-5 <\/span><\/i><span style=\"font-weight: 400\">Written copies of the tentative agreement summary should be given to the\u00a0 general membership prior to ratification.<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-6 <\/span><\/i><span style=\"font-weight: 400\">Conduct all ratifications of collective bargaining agreements in\u00a0 accordance with the guidelines for ratification of collective bargaining agreements and fact\u00a0 finder reports as set forth in the OEA Elections Manual.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-7 <\/span><\/i><span style=\"font-weight: 400\">A vote on a tentative agreement to the contract or on a fact-finding report\u00a0 shall be made by written ballot.\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> No absentee or proxy votes will be allowed on contract ratification votes or fact-finding\u00a0 reports.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> The first vote on contract ratification or a fact-finding report will be to accept or reject the\u00a0 contract\/report as presented.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> All ballots used in a vote regarding a contract ratification or fact-finding report, after\u00a0 tabulation, will be sealed and retained by the Association Treasurer for two (2) years or duration\u00a0 of contract, whichever is greater.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> The President will communicate required details of the ratification vote to the employer\u2019s\u00a0 designated representative.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-8 <\/span><\/i><span style=\"font-weight: 400\">The designated representative for the Association is authorized to give\u00a0 timely notice of intent to strike to the Board of Education and SERB upon approval of the\u00a0 membership and in keeping with provisions of ORC 4117.14 (D) (2).\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 5-9 <\/span><\/i><span style=\"font-weight: 400\">Non-members of the Association are not eligible to vote on a fact finder\u2019s\u00a0 report or contract ratification.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 6. DUES\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 6-1 <\/span><\/i><span style=\"font-weight: 400\">The annual dues of this Association shall be 0.19% of the base salary for\u00a0 a B.A. degree on the current Buckeye Local Salary Schedule. The dues rate for the succeeding\u00a0 year shall be determined by the April meeting of the Board of Directors\/Executive Committee\u00a0 subject to approval by a simple majority of membership.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 6-2 <\/span><\/i><span style=\"font-weight: 400\">Every member shall also pay the dues required by the district, state, and\u00a0 national associations with which this local is affiliated.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 6-3 <\/span><\/i><span style=\"font-weight: 400\">The association shall annually enter into a Dues Transmittal Agreement\u00a0 with the Ohio Education Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 7. MEMBERSHIP YEAR\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 7-1 <\/span><\/i><span style=\"font-weight: 400\">The membership year of the Association shall be September 1 to August\u00a0 31.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 8. EXPULSION OF MEMBERS<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 8-1 <\/span><\/i><span style=\"font-weight: 400\">According to procedures adopted by the Association, the Board of\u00a0 Directors\/Executive Committee may censure, suspend from membership, or expel any member\u00a0 for one or more of the following reasons:\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Violation of the Code of Ethics of the Education Profession.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Conviction of a felony.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Actively engaging in, or actively supporting activities directed against the constitutional\u00a0 purposes of the Association to bring about changes in the Association by means other than\u00a0 those that are consistent with the Association\u2019s Constitution.\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 8-2 <\/span><\/i><span style=\"font-weight: 400\">The Board of Directors\/Executive Committee may reinstate members\u00a0 previously suspended or expelled.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 9. DUE PROCESS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 9-1 <\/span><\/i><span style=\"font-weight: 400\">The Association guarantees that no member may be censured,\u00a0 suspended, or expelled without a due process hearing, which shall include an appropriate\u00a0 appellate procedure.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 10. AUTHORITY \u2013 PARLIAMENTARY PROCEDURE\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 10-1 <\/span><\/i><span style=\"font-weight: 400\">Robert\u2019s Rules of Order, Newly Revised shall be the authority governing\u00a0 all matters of procedure not otherwise provided in this constitution, bylaws, or standing rules.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 11. AMENDMENTS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 11-1 <\/span><\/i><span style=\"font-weight: 400\">Amendments, alterations, additions, or deletions to these Bylaws shall be\u00a0 made by a majority vote of the total active membership of the Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 11-2 <\/span><\/i><span style=\"font-weight: 400\">Changes shall be proposed upon the initiative of the Constitution\u00a0 Committee or upon presentation to the Board of Directors\/Executive Committee of a petition\u00a0 signed by twenty (20) percent of the current active membership. All proposed changes shall be\u00a0 submitted in writing to all active members at least ten (10) days prior to action.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 12. DISSOLUTION OF ASSOCIATIONS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 12-1 <\/span><\/i><span style=\"font-weight: 400\">A petition for dissolution of the Association may be presented in writing to\u00a0 a meeting of the general membership by any member in good standing and must contain the\u00a0 signature of three-fourths (3\/4) of the total membership of the Association.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 12-2 <\/span><\/i><span style=\"font-weight: 400\">Upon receipt of the petition for dissolution by the total membership, the\u00a0 Association shall act upon the petition at the next general membership meeting.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 12-3 <\/span><\/i><span style=\"font-weight: 400\">The Association shall be considered dissolved if three-fourths (3\/4) of the\u00a0 total membership vote by secret ballot in favor of dissolution.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 12-4 <\/span><\/i><span style=\"font-weight: 400\">The effective date of dissolution shall be thirty (30) days from the date of\u00a0 the vote, thus allowing for the disposal of assets and liabilities.<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 12-5 <\/span><\/i><span style=\"font-weight: 400\">In the event of dissolution of the Association, all assets of this\u00a0 organization remaining after payment of all obligations shall be distributed to the Buckeye Local\u00a0 Classroom Teachers\u2019 Association Scholarship provided that it is an entity recognized as exempt\u00a0 from Federal taxation. In the event that the BLCTA Scholarship is not then recognized as tax\u00a0 exempt, such assets shall then pass to Buckeye Local Close-Up program provided that is\u00a0 recognized as exempt from Federal taxation.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>BYLAW 13. ENABLING PROVISION\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 13-1 <\/span><\/i><span style=\"font-weight: 400\">This Constitution and these Bylaws shall become effective September 1,\u00a0 2011, following their adoption, and shall remain in effect until amended according to regulations\u00a0 herein provided.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 13-2 <\/span><\/i><span style=\"font-weight: 400\">This Constitution shall remain consistent with the Constitution of the OEA. <\/span><b>APPENDIX A\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><b>BYLAW 14. GROUNDS FOR CHARGES AGAINST MEMBERS AND OFFICERS\u00a0<\/b><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 14- 1. <\/span><\/i><span style=\"font-weight: 400\">Every member of the Association, by virtue of such membership, agrees\u00a0 that, in consideration of the rights and benefits conferred upon him or her pursuant to the terms\u00a0 of the Association Constitution, her or she shall be subject to disciplinary action for any conduct\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">which constitutes a violation of his or her duties and obligations as stated in Section 2 below.\u00a0 Every member, by virtue of his or her membership, agrees that termination of membership does\u00a0 not terminate his or her liability for discipline for acts occurring during the period of his or her\u00a0 membership.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><i><span style=\"font-weight: 400\">Section 14- 2<\/span><\/i><span style=\"font-weight: 400\">. Any member or elected or appointed officer may be charged and\u00a0 disciplined for engaging in conduct which constitutes a violation of his or her duties and\u00a0 obligation to the membership. The basis for such charges shall include, but not be limited to, the\u00a0 following:\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Violating any provision of the approved Constitution or established Bylaws of the Association\u00a0 or its affiliates.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Failing to pay dues, fines, assessments, fees, and other financial obligations owed to the\u00a0 Association or its affiliates in a timely manner.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Obtaining membership by misrepresentation or through other fraudulent means.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Working in the interest of, or accepting membership in, any competing organization with\u00a0 interests dual to the Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Furnishing a complete or partial list of the membership of the Association to any\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">person other than those whose position entitles them to have a list, without specific\u00a0 authorization in writing from the Association President.\u00a0<\/span><\/p>\n<ol style=\"text-align: left\">\n<li><span style=\"font-weight: 400\"> Deliberately engaging in conduct, which violates the responsibility of members toward the\u00a0 Association as an institution.<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Unreasonably, unlawfully or improperly disturbing the peace or harmony of any meeting of\u00a0 the Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Embezzling, misappropriating, fraudulently receiving, wrongfully handling, or failing to\u00a0 account for the funds of the Association, or any employee benefit fund.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Wrongfully taking, retaining, or destroying any money, books, papers or any other property\u00a0 belonging to the Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Using the name of the Association for soliciting funds, for advertising, or for any other similar\u00a0 activities.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Crossing or working behind a lawful and properly authorized picket line established by the\u00a0 Association.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Working for lower wages, longer hours, or other conditions inferior to those established by the\u00a0 Association collective bargaining agreement.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\"> Acting in any way to circumvent, defeat or interfere with: (1) the Association\u2019s collective\u00a0 bargaining agreement with the employer or (2) the\u00a0<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><span style=\"font-weight: 400\">Association\u2019s performance of its legal or contractual rights or obligations.\u00a0<\/span><\/p>\n<ol>\n<li style=\"text-align: left\"><span style=\"font-weight: 400\"> Disclosing any confidential matter of Association or its affiliates to any employer or employer\u00a0 agent.\u00a0<\/span><\/li>\n<li style=\"text-align: left\"><span style=\"font-weight: 400\"> Acting in collusion with any employer or employer agent to the detriment of the Association.\u00a0<\/span><\/li>\n<li style=\"text-align: left\"><span style=\"font-weight: 400\"> In the case of any elected or appointed Officer of the Association, failing to faithfully perform\u00a0 the duties of his or her office or position, or accepting dual compensation or expenses for the\u00a0 performance of duties related to his or her office or position.\u00a0<\/span><\/li>\n<li style=\"text-align: left\"><span style=\"font-weight: 400\"> Making false and malicious statements, which jeopardize the employment or reputation of\u00a0 another Association member.\u00a0<\/span><\/li>\n<li style=\"text-align: left\"><span style=\"font-weight: 400\"> Filing a malicious and frivolous charge against a member or Officer, as evidenced by the\u00a0 Hearing Board\u2019s dismissal of said charge with a finding that the charge was malicious and\u00a0 frivolous.<\/span><\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>OHIO EDUCATION ASSOCIATION\u00a0 Scott W.
